General Terms and Conditions (GTC)

The user accepts the following General Terms and Conditions in its relevant version by visiting TRANACOM’s website.

TRANACOM shall undertake its utmost to regularly and conscientiously update all the data and information published on its website. TRANACOM cannot accept any liability or guarantee that the data and information is up-to-date, correct and exhaustive as this data and information originates from various sources outside its area of responsibility. The user uses this data and information expressly at his own risk and responsibility.

Cross-references and links regarding websites of third parties lie beyond the sphere of responsibility of TRANACOM. The user accesses and uses such websites at his own risk. TRANACOM declares expressly that it has no influence on the design, the content and the offers of the linked websites. The operators of the linked-to websites are responsible for information and services provided on these pages in their entirety. TRANACOM shall not accept any liability or responsibility for such websites.

TRANACOM reserves the right to change or delete contents in part or in whole at any time without giving notice or to decide not to publish proffered texts. TRANACOM makes every effort to ensure that only serious web addresses and entries are displayed and no illegal, pornographic, racist, unsubstantial or other unserious and destructive websites and entries are included in its directory.

No rights as regards the content are acquired or transferred through downloading or copying content, images or other data. TRANACOM reserves the right to take legal steps in case of violation or misuse of its trade rights.

TRANACOM shall treat personal data strictly confidentially and shall not sell nor pass it on to third parties. The customer confirms that he will provide TRANACOM solely with data that he is authorised to forward. The customer releases TRANACOM from all claims of third parties as regards the given data. The customer is aware of the risk for all participants of interception of the submitted data during transmission. The customer agrees that his personal data which has been given to TRANACOM within the framework of the General Terms and Conditions be stored and automatically processed in TRANACOM’s EDP system.

All offers shall be subject to confirmation and non-binding. The conclusion of the contract with TRANACOM shall be executed solely in writing (acceptance of the offer by order confirmation by the customer via e-mail) and begins at the earliest pursuant to the terms of the corresponding contract. The customer also accepts the General Terms and Conditions of TRANACOM by confirmation of the order.

TRANACOM reserves the right to change the General Terms and Conditions at any time.

Swiss law alone applies for the content and use of the information provided on TRANACOM’s website to the exclusion of international conflicts of law. Place of performance for all services is the domicile of TRANACOM in CH–8872 Weesen/SG. Court of jurisdiction is CH–8872 Weesen/SG.

The validity of the other terms and conditions will not be affected, if one of these terms and conditions becomes invalid. Invalid terms and conditions shall, if possible, be replaced by such valid terms and conditions which achieve the purpose of the contract.
